SAMWUMED MEDICAL SCHEME PLACED UNDER PROVISIONAL CURATORSHIP

Dear Members,

The Western Cape Division of the High Court in Cape Town has on 3rd May 2018, placed the South African Municipal Workers Union Medical Aid Scheme (SAMWUMED) under provisional curatorship following a successful application by the acting Registrar of the Council for Medical Schemes (CMS), in terms of Section 56(1) of the Medical Schemes Act, No. 131 of 1998 (the MS Act), and Section 5(1) and (2) of the Financial Institutions (Protection of Funds) Act 28 of 2001b (the FI Act).

As a result, Acting Judge P Andrews ordered that Ms. Duduza Khosana be appointed as Provisional Curator for SAMWUMED.

She assumes all powers previously vested in the Board of Trustees and Management of SAMWUMED in managing the affairs of the Scheme.

SAMWUMED has assured the public that the Scheme’s priority remains quality service in the interest of its members.

It has assured its membership that the curatorship will have no adverse impact on their medical aid membership with SAMWUMED and that all benefits and valid claims will be honoured per the Scheme Rules.

The CMS press release relating to the curatorship decision is attached.
